Terms of Service

Last updated: 25 July 2026

1. Who we are

Heads Up Tenders ("we", "us", "our") is operated by Heads Up Tenders, ABN 78 508 214 468, a business registered in Victoria, Australia. These Terms govern your use of the Heads Up Tenders website and subscription service (the "Service").

2. What the Service does

Heads Up Tenders monitors publicly available Australian government tender portals and sends email and/or SMS alerts to subscribers based on keywords, trade categories, and location preferences they select.

Heads Up Tenders acts solely as a notification layer between subscribers and official government tender portals. We do not create, publish, issue, or have any involvement in any tender, contract, or work opportunity. Every tender referenced in an alert originates from, and remains hosted on, the relevant government agency's own portal — Heads Up Tenders simply identifies it as a potential match and links you to it. We are not a recruitment, lead-generation, or work-finding service, and we do not generate work or guarantee the availability of work.

3. No guarantee of accuracy or completeness

Heads Up Tenders is an informational notification service only. We do not guarantee that:

You are solely responsible for verifying tender details and submission requirements directly with the relevant government agency or portal.

4. Subscriptions, billing, and free trials

The Service is offered on a subscription basis at the prices displayed at checkout. New subscriptions include a 14-day free trial. Unless cancelled before the trial ends, your subscription will automatically renew and you will be charged the plan price shown at signup, on a recurring monthly basis, until you cancel.

You can cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — no partial refunds are provided for unused time within a billing period, except as required by Australian Consumer Law.

5. Acceptable use

You agree not to: resell, redistribute, or republish alert content as a competing service; attempt to scrape, reverse-engineer, or excessively automate requests to the Service; use the Service for any unlawful purpose.

6. Limitation of liability

To the maximum extent permitted by law, Heads Up Tenders excludes liability for any indirect, incidental, or consequential loss arising from use of the Service, including loss of business opportunity, lost profits, or missed tenders. Nothing in these Terms excludes any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

7. Changes to the Service or these Terms

We may update these Terms or change, suspend, or discontinue features of the Service from time to time. Material changes will be notified to subscribers by email.

8. Governing law

These Terms are governed by the laws of Victoria, Australia.
